A Florida familyโ€™s trip to SUPER NINTENDO WORLD ended not with a high score, but with a shoplifting accusation, a 30-minute interrogation, and a permanent trespass orderโ€”all over a $16 Mario keychain.

Now, the heavy-hitting law firm Morgan & Morgan is stepping in, challenging Universal Orlandoโ€™s “zero-tolerance” security protocols and demanding accountability for what they describe as a traumatic overreaction.


The Incident: A Split-Second Decision in SUPER NINTENDO WORLD

The controversy began inside a crowded gift shop within the Nintendo-themed land on December 27. According to Nikki Daou and her attorney, Rick Block of Morgan & Morgan, the familyโ€™s daughterโ€”who has severe autismโ€”began to experience a sensory meltdown due to the overwhelming crowds and noise.

In an effort to de-escalate the situation, Daou took her daughter and the Mario keychain the child was holding outside the store to find a quiet space. Meanwhile, her husband remained inside the store, holding the ripped-off barcode for the keychain and standing in line to pay for it along with their other souvenirs.

Despite the family's intent to pay, the situation escalated rapidly:

  • The Confrontation: Within minutes of stepping outside, Daou says she was approached by plainclothes security who accused her of shoplifting.
  • The Interrogation: The family was reportedly escorted to a private security office and interrogated for 30 minutes.
  • The Ban: Following the interrogation, the family was issued an immediate permanent trespass order, banning them from all Universal properties.

Morgan & Morgan vs. Universal: The Legal Fallout

The legal team at Morgan & Morgan isn't just looking for an apology; they are challenging the legality of Universal's aggressive “loss prevention” tactics. Attorney Rick Block has described the situation as “beyond abhorrent,” noting that there was no criminal intent to deprive the park of the merchandise.

The tension spiked even further when the family received a letter from a Universal attorney three days after the incident. The letter demanded $200 in civil damages for the “intentional” deprivation of merchandiseโ€”a move Morgan & Morgan argues is baseless given the circumstances.

In response, the firm has sent its own demand to Universal, citing:

  1. Abuse of Process: Challenging the use of security and police intervention in an apparent misunderstanding.
  2. False Imprisonment: Addressing the 30-minute detention of the family in the security office.
  3. Negligence: Highlighting the failure of staff to follow ADA-compliant procedures despite the family having pre-registered their child's disability with Guest Services.

A Pattern of Conflict at Epic Universe?

This incident comes at a sensitive time for the brand-new theme park. While Epic Universe has been lauded for its immersion, it has also faced scrutiny over its security and operational culture. This lawsuit raises questions about whether Universal's pressure to minimize theft in high-traffic areas, such as SUPER NINTENDO WORLD, is leading to a “shoot first, ask questions later” approach to security.

Unlike typical shoplifting cases, the Daou family is not seeking a massive financial payout for themselves. Instead, they are requesting that Universal revoke the trespass ban and make a sizable donation to a charity supporting individuals with disabilities.

Universal Orlando has generally declined to comment on pending litigation but has acknowledged the receipt of the demand letter.   1. This also could have been avoided if the family had simply given the entire keychain to the father to pay for while taking the child outside to a quieter area. Demanding that Universal donate to a charity and issue an apology when you did in fact actually shoplift, whether intentional or not, is the wrong path to take. The correct resolution is to try to meet in the middle by admitting your mistake and ASKING that they lift the ban. Hiring a lawyer and making demands only makes the situation worse because by definition you did shoplift and now Universal is forced to dig in their heels.
