DOLE Lying About Iconic DOLE Whip? New Lawsuit Says Yes

Dole Whip has developed into an iconic treat closely associated with Disney theme parks over the past several decades. Known for its refreshing and creamy texture, the pineapple-flavored soft serve has become a must-try item for visitors at both Disneyland and Walt Disney World.

The popularity of Dole Whip is attributed to its unique attributes, including being dairy-free, making it a sought-after dessert for individuals with lactose intolerance.

In 2023, Dole made a significant expansion by selling its DOLE Whip products in grocery stores across the country. This move aimed to capture a broader audience beyond Disney parks, allowing fans of the treat to enjoy it at home. Alongside the original pineapple flavor, Dole introduced additional flavors such as lime, orange, strawberry, lemon, and coconut.

Unfortunately, a new lawsuit is claiming that the DOLE Whip might not be as wholesome as the company makes it seem.

In a recent lawsuit filed in California, a consumer named Julian Aguilar claims DOLE misleads customers by promoting DOLE Whip as free of artificial ingredients. The lawsuit states that flavors like Pineapple, Mango, and Strawberry are advertised as containing “real fruit” and “no artificial additives,” but Aguilar argues that DOLE’s labeling is deceptive, given that the product contains preservatives like citric acid and xanthan gum.

Aguilar’s legal filing further alleges that the citric acid in DOLE Whip is not derived from fruit but produced through a fermentation process involving modified black mold (Aspergillus niger).

According to Aguilar, this process contradicts DOLE’s “natural” claims and potentially poses health risks, including joint pain and respiratory symptoms. Aguilar seeks class-action status for the suit and demands that DOLE pay damages, cover legal fees, and conduct a corrective advertising campaign to clarify the product’s actual contents.

This lawsuit isn’t DOLE’s first legal challenge regarding product labeling. Earlier this year, the company faced another lawsuit over its gummy snacks, which were marketed as a healthy option.

Plaintiffs in that case argued that, despite the “natural” messaging, the snacks contained high levels of sugar, making them less healthy than consumers might assume.

These back-to-back cases illustrate the risks companies face when promoting products as “natural” or “healthy” without full transparency. With more consumers paying attention to ingredients and health implications, brands like DOLE are finding it increasingly challenging to keep up with expectations for honest labeling.
